TESCA ENTERPRISE LLC, and/or its affiliates (“TESCA 3PL SERVICES”, “we”, “website” or “us”) operate a prep center to offer 3PL services to online sellers with the web address https://tesca3plservices.com/ from where you may contact the company to obtain 3PL services for your business needs.
These Terms of Use apply to the content and functionality of the TESCA 3PL SERVICES, and to the services offered by us. These Terms of Use do not apply to products or services that we make available pursuant to different terms.
1. Information that you provide to us
You may give us information about yourself when you contact us. Your information is not shared with anyone else unless allowed by you in writing. We may need to send you email and text messages to, for example, verify your identity or provide you with important information. You authorize us to send those messages when you visit the website and provide your contact details. Standard text or data charges may apply to text messages. Where offered, you may disable text message notifications by responding to any such message with “STOP”, or by following instructions provided in the message. However, by disabling text messaging, you may be disabling an important contact method and may increase the risk of loss to your business.
2. Products, Content and Specifications
TESCA 3PL SERVICES only offers packing and shipping services to online sellers. Details of the services available for purchase in the TESCA 3PL SERVICES are set out on the website. All services described or depicted in this website are subject to change at any time without notice. Unless expressly noted, all images and descriptions are approximate and are provided for convenience purposes only. Packaging may vary from that shown, and the appearance of packaging may differ from its appearance to you on the website due to the limitations of the systems that you use to access the website. The inclusion of any services on the website at a particular time does not imply or warrant that these products or services will be available at any time.
3. Contact Method
Customers can reach out to us using any of the contact methods provided on our website. All communication is done via email or messaging. Other means of communication may be used as needed.
Customers can provide details of orders, shipments, their products or labels to us via email, text messages, WhatsApp messages, google sheets, Excel sheets or any other online platform (based on availability at that time).
4. Customer Responsibility
Customers are responsible for the following:
- Provide up to date and accurate information regarding their products arriving to our address. This information includes product description, pictures, quantity and estimated arrival date.
- The customer is responsible for providing accurate and detailed instructions on the type of services needed for each product.
- The customer is responsible for providing accurate, original and up to date labels for the items that need to be shipped. Labels should be clear and in correct format (4×6 thermal printer format for carrier labels and 3×2 thermal printer format for FNSKU). Any labels that are not clear or found to be illegal shall not be shipped.
- Labels for FBM (Fulfilled by Merchant) services should be sent via any of the communication methods described in section 3 to TESCA 3PL SERVICES by 9pm of each business day (Except for US National holidays).
- The customer is responsible for maintaining records of his products stocked at TESCA 3PL SERVICES.
- Being the owner of the products, the customer is responsible for ensuring that the products are authentic, original and are not causing any trademark infringement. TESCA 3PL SERVICES is not liable for sale of any product that is later found to be unauthentic or fake copy of a trademarked product.
- Customer to make arrangements to clear invoices within 1 week of issuance.
5. TESCA 3PL SERVICES Responsibility
Tesca 3PL Services is responsible for the following:
- Receiving customer’s inventory and confirm receipt to the customer within 3 days of receipt.
- Store customers’ inventory safely, and ship out timely based on the labels provided by the customer. Please refer to Section 7 for shipping policy details.
- Pack customer’s products in a bag or box (based on product size/weight) and apply shipping label supplied by the customer before handing over to shipping carrier.
- TESCA 3PL SERVICES does not provide labels and will only use the labels supplied by customers.
- TESCA 3PL SERVICES does not provide products and only packs/ships the products provided by the customers. We are not liable for any unauthentic or fake products shipped from our location.
- Maintain detailed records of the services/charges and provide weekly invoices for the services offered during the week.
- Inform customers in time of any issues that may arise due to unforeseen circumstances that may cause delays in shipping of customers’ products.
6. STORAGE POLICY
All customers’ products are to be stored in a safe place. For active customers, no storage fee will be charged. For inactive customers (no orders shipped within the last 30 days), storage fee will be charged based on volume of product stored at TESCA 3PL SERVICES location. Base rate is $2 / cubic feet / month which is subject to change based on additional terms agreed between the customer and us. Any product left at TESCA 3PL SERVICES location for more than 3 months with no communication from the customer or non-payment will be discarded.
7. ORDER FULFILLMENT POLICY
- All FBA/WFS orders to be shipped within 3 business days of receipt of labels from the customer.
- All FBM orders received before 9PM on a business day will be shipped out the following business day (except for the US National Holidays).
- TESCA 3PL SERVICES will ship customers’ orders via any of the 3 major carriers (Fedex, UPS and USPS).
- TESCA 3PL SERVICES is responsible for the product until it’s handed over to the shipping carrier. We are not responsible for the product lost or damaged during transit to the destination.
8. RETURNS POLICY
Any returns issues to the customer for the online orders may be shipped to TESCA 3PL SERVICES. We can receive the returned product, inspect it and update the customer on the product condition. Product can then either be added to the customer’s stock or discarded as advised by the customer. In some cases, the return fee may be charged to the customer.
9. REFUND POLICY
If TESCA 3PL SERVICES is found to be responsible for any delay in shipping customers’ orders in a timely manner, a refund can be issued to the customer for that order in the form of adjustment in their upcoming invoice. However, any delays in product delivery due to shipping carrier cannot be used as a reason for requesting a refund from us.
10. CANCELLATION POLICY
Orders cancelled by the customer prior to us handing them over to the shipping carrier are acceptable and will not incur service charges. However, in some cases a small fee may be charged to cover any packaging material that was used for packing cancelled order.
11. Sanctions and export policy
You will not ship products to TESCA 3PL SERVICES that have been purchased from a country, organization, entity, or person embargoed or blocked by any government, including those on sanctions lists identified by the United States Office of Foreign Asset Control (OFAC).
9. No warranties
We provide the services “as is” and “as available”, without any express, implied, or statutory warranties of title, merchantability, fitness for a particular purpose, non-infringement, or any other type of condition, warranty or guarantee. No data, documentation or any other information provided by us or obtained by you from or through the website – whether from TESCA 3PL SERVICES or another entity, and whether oral or written – creates or implies any warranty from us to you.
TESCA 3PL SERVICES disclaims any knowledge of and does not guarantee: (a) the accuracy, reliability, or correctness of any data provided through the website; (b) that the TESCA 3PL SERVICES will meet your specific needs or requirements; (c) that the TESCA 3PL SERVICES will be available at any particular time or location or will function in an uninterrupted manner or be secure.
Nothing in these Terms of Use operates to exclude, restrict or modify the application of any implied condition, warranty or guarantee, or the exercise of any right or remedy, or the imposition of any liability under law to the extent that doing so would: (a) contravene that law; or (b) cause any term of this agreement to be void.
10. Limitation of liability
Under no circumstances will TESCA 3PL SERVICES be responsible or liable to you for any indirect, punitive, incidental, special, consequential, or exemplary damages resulting from your inability to follow the US law, or for lost profits, personal injury, or property damage, or for any other damages arising out of, in connection with, or relating to these Terms of Use or your use of our services, even if such damages are foreseeable, and whether or not you or TESCA 3PL SERVICES has been advised of the possibility of such damages. TESCA 3PL SERVICES is not liable, and denies responsibility for any damage, harm, or losses to you arising from or relating to hacking, tampering, or other unauthorized access or use of our services or your failure to use or implement anti-fraud measures, security controls, or any other data security measure. TESCA 3PL SERVICES further denies responsibility for all liability and damages to you or others caused by (a) any errors, inaccuracies, omissions, or losses in or to any data provided to us; (b) third-party content provided by you; or (f) the defamatory, offensive, or illegal conduct of you or others.
You agree to limit any additional liability not disclaimed or denied by TESCA 3PL SERVICES in relation to our services, to your direct and documented damages; and you further agree that under no circumstances will any such liability exceed in the aggregate the greater of the amounts paid by you to TESCA 3PL SERVICES during the three-month period immediately preceding the event that gave rise to your claim for damages.
These limitations on our liability to you will apply regardless of the legal theory on which your claim is based, including contract, tort (including negligence), strict liability, or any other theory or basis.
11. Applicable law
By using the TESCA 3PL SERVICES, you agree that the laws of the state of Texas, USA, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and us.
12. Modification and severability
We have the right to change or add to the terms of these Terms of Use at any time, solely with prospective effect, and to change, delete, discontinue, or impose conditions on use of the TESCA 3PL SERVICES by posting such changes on our website or any other website we maintain or own. You can access a copy of the current version of these Terms of Use on our website at any time. You can find out when these Terms of Use were last changed by checking the “Last updated” date at the top of the page.
